Agreement to these terms

DrawDuel.io is operated by 5Head Labs Pty Ltd, an Australian company. These terms are the agreement between you and that company for using the game and this website, and "we", "us" and "our" mean it throughout. By playing a duel, creating an account, or otherwise using DrawDuel.io, you accept these terms. If you do not agree with them, do not use the service.

We may update these terms as the game changes. The "last updated" date at the top shows when, and continuing to play after a change means you accept the new version.

Who can play

DrawDuel.io is not directed at children under 13, and you must be at least 13 to use it. If you are under the age of majority where you live, you may only use DrawDuel.io with a parent or guardian who agrees to these terms on your behalf.

Your account

You can play as a guest, or sign in to keep your rank and history between sessions. You are responsible for activity that happens under your account and for keeping your sign-in secure.

Pick a display handle that is not offensive, impersonating, or misleading. We can reset a handle that breaks this rule.

You can have your account, and the data attached to it, deleted at any time by messaging us on our Discord at https://discord.gg/BcbP9aSz7M. We check that the account is yours before erasing anything, as the privacy policy describes. We may suspend or remove an account that violates these terms.

Fair play and conduct

Play the game as intended. Do not cheat, automate input, exploit bugs, manipulate match results or the ranked ladder, or try to game the AI judge, Judge Bob, with anything other than an honest drawing.

Do not draw or submit content that is illegal, hateful, harassing, sexually explicit, or that infringes someone else’s rights. The same goes for your handle and anything else you type into the game.

Do not attack the service: no scraping beyond what robots.txt allows, no overwhelming our systems, no probing for vulnerabilities outside our published security policy, and no interfering with other players’ matches.

Your drawings and content

You keep ownership of the drawings you make in DrawDuel.io. Because a finished duel can appear on public replay and leaderboard pages, you grant us a worldwide, royalty-free license to host, display, and share your drawings and handle as part of running and promoting the game.

This license lasts while the content is part of the service. Deleting your account removes your drawings from the pages tied to it, though an anonymized match result may remain so historical rankings stay consistent.

Only submit content you have the right to share, and that follows the conduct rules above.

The AI judge

Each duel is scored by Judge Bob, an automated AI judge. His decisions are final for the purpose of the match and the ranked ladder. Judge Bob is software and can be imperfect, so results are provided as part of a game and not as any objective measure of artistic skill.

Advertising

We may show ads to keep DrawDuel.io free. Which provider serves them, how that works and how to opt out is covered in our Privacy Policy.

Availability and changes

We work to keep DrawDuel.io running but do not promise it will always be available, uninterrupted, or bug-free. We may add, change, or remove features, and we may suspend or end the service, at any time.

Your rights under Australian Consumer Law

If you are a consumer in Australia, the Australian Consumer Law gives you guarantees that cannot be excluded, restricted or modified by any agreement, including this one, and nothing in these terms tries to. Among them: services must be supplied with due care and skill, be fit for any purpose we have told you they are fit for, and be supplied within a reasonable time.

If we fail one of those guarantees you are entitled to a remedy. For a major failure you can cancel the service and get a refund, or keep it and claim compensation for the drop in value. For a failure that is not major, you are entitled to have the problem fixed within a reasonable time, and to cancel and get a refund if we do not fix it. You may also be entitled to compensation for reasonably foreseeable loss.

Where anything in these terms conflicts with those guarantees, the guarantees win and the conflicting words simply do not apply to you. If you are a consumer somewhere other than Australia, the equivalent rights your own law does not let us exclude apply in the same way.

Disclaimers

Apart from the guarantees described above, and any other rights the law does not allow us to exclude, DrawDuel.io is provided "as is" and "as available", without warranties of any kind, whether express or implied. We do not warrant that the game will meet your expectations, or that results, rankings, or the AI judge will be accurate or error-free.

To be explicit, because an "as is" line can read as though it sweeps everything away: it does not. If you are an Australian consumer, the consumer guarantees above apply to this service whatever this section says.

Limitation of liability

Subject to your rights under the Australian Consumer Law described above, and to the fullest extent the law permits, we are not liable for indirect, incidental, special or consequential loss arising from your use of DrawDuel.io, and our total liability for all claims relating to the service is limited to the amount you paid us for it in the twelve months before the claim arose. If you have paid us nothing, that amount is nil.

That limit does not apply to liability that cannot be limited by law, which includes liability under the consumer guarantees above, liability for death or personal injury caused by our negligence, and liability for fraud.

Termination

You can stop using DrawDuel.io at any time, and ask us to delete your account whenever you like. We may suspend or end your access if you break these terms or to protect the service and its players. Sections that by their nature should survive (content license for material still public, disclaimers, and liability limits) continue after access ends.

Governing law and where disputes are heard

These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts that hear appeals from them.

"Non-exclusive" matters most if you are outside Australia: it means this section does not take away a right you have to bring a claim where you live, in the cases where your local consumer law gives you one.

Changes to these terms

If we change these terms we will update this page and the date at the top, and call out material changes on the site. Your continued use after a change means you accept it.
